In anticipation of new legislation expected to come into effect in late 2026, we are taking this opportunity to clarify and outline the requirements for a Place of Public Entertainment (POPE) permit.
As part of this review, some events that have previously been held without the requirement to obtain a POPE Permit may now be required to do so. Following consultation with the Building and Plumbing Commission, Council was required to amend aspects of its policy regarding the enforcement of POPE permits, which had not been consistently applied in the past. In addition, our new Municipal Building Surveyor has identified a number of events that were not meeting current standards and legislative requirements.
Please also note that where the Municipal Building Surveyor determines that a POPE Permit is required, an Event Permit from the Events team will not be issued until the POPE Permit has been received and Council has been notified. This ensures that all legislative obligations are met and that events are delivered in compliance with all legal requirements.
A POPE Permit is required when ANY of the following are true:
- A building is intended to be used for public entertainment
OR
A place which is used or intended to be used for the purpose of public entertainment IF:
- The place is enclosed or substantially enclosed OR
- The place can only be accessed by payment of money or giving of other consideration
The definitions under the Building Act and the Building Regulations 2018 operate to provide that the following are POPE (Places of Public Entertainment)
- Prescribed places – area greater than 500m² (exemption of place used for events by community-based org and no more than 5000 peoples)
- A building in the prescribed classes of buildings (ie. Class 9b buildings having an area greater than 500m² and prescribed temporary structures) used or intended to be used for the purpose of providing public entertainment
A place in the prescribed class of places:
- Which is enclosed or substantially enclosed, or
- To which admission can be gained by payment of money or the giving of other consideration; and
- That is used or intended to be used for the purpose of providing public entertainment.
The following are prescribed temporary structures that require an Occupancy Permit from Building and Plumbing Commission before they can be used for public entertainment:
- A seating stand for more than 20 people
- A marquee larger than 100 square metres
- A tent larger than 100 square metres
- A booth larger than 100 square metres
- A stage or platform larger than 150 square metres
- Prefabricated buildings with an area exceeding 100m2 and that are not placed directly on the ground surface
