Proposed removal of laneway access, Bairnsdale

East Gippsland Shire Council gives notice under section 206 and Schedule 10 Clause 3 of the Local Government Act 1989 (“the Act”) that it proposes to remove from the Register of Public Roads laneway access between 259 Main Street and 124 Macleod Street, Bairnsdale.

If removed from the Register of Public Roads, Council proposes close the road to sell the land from the road by private treaty to the abutting property owners.

Under section 223 of the Act, any person wishing to make a submission on the proposal must do so in writing by Friday 18 January 2022.

A person can request in their submission that they wish to appear in person, or to be represented by a person specified in the submission, in support of the submission at a meeting of Council or its Committee on a date, time and place to be determined by the Council.

All submissions will be considered in accordance with section 223 of the Act and will be handled in accordance with the provisions of the Privacy and Data Protection Act 2014.

Following the consideration of any submissions, Council may decide to discontinue and sell the road, part of the road, or not to discontinue and sell the road.
