Exhibited Planning Scheme Amendments

The amendments listed below are currently on exhibition. Any person may make a written submission to Council about an amendment during the exhibition period.

How to make a submission

You may inspect the amendment, any documents that support the amendment and the explanatory report about the amendment, free of charge, at the following locations:

  • During office hours at the council customer service centre noted in the explanatory report; or

Any person who may be affected by the amendment may make a submission to the planning authority about the amendment.

 

Submissions must be made in writing giving the submitter’s name and contact address, clearly stating the grounds on which the amendment is supported or opposed and indicating what changes (if any) the submitter wishes to make. 

 

Name and contact details of submitters are required for council to consider submissions and to notify such persons of the opportunity to attend council meetings and any public hearing held to consider submissions.

 

A submission must be sent to the Manager Strategic Planning, East Gippsland Shire Council, PO Box 1618 Bairnsdale Vic 3875 or by email.

 

The planning authority must make a copy of every submission available at its office for any person to inspect free of charge for two months after the amendment comes into operation or lapses.

Exhibited Planning Scheme Amendments

 

Amendment C139: Tambo Bluff Estate

 

East Gippsland Shire Council has prepared Amendment C139 to the East Gippsland Planning Scheme.

 

The land affected by the amendment is within Tambo Bluff Estate and is outlined in the explanatory report.

 

The amendment proposes to:

  • Remove redundant zone and overlay controls on identified land within the Tambo Bluff Estate where land has been acquired or consolidated in accordance with the restructure plan.
  • Apply a Public Acquisition Overlay (PAO) to undevelopable lots in the Restructure Plan area to enable council to acquire these lots, in accordance with the updated Tambo Bluff Restructure Plan 2018.
  • Apply relevant zone and overlay controls on identified land within the Tambo Bluff Estate to reflect the land use in accordance with the restructure plan.

Amendment C147: 35 Rowe Street, Lakes Entrance

 

East Gippsland Shire Council has prepared Amendment C147 to the East Gippsland Planning Scheme.

 

The land affected by the amendment is 35 Rowe Street, Lakes Entrance (Crown Allotment 46D, Parish of Colquhoun).

 

The amendment proposes to rezone the land from Public Park & Recreation Zone to Commercial 1 Zone to align the zoning of the land with the longstanding use and development of the site as a Bowling Club.

 

Submissions close 5.00pm May 11, 2018.

Amendment C126: King Street and Slip Road, Paynesville

 

East Gippsland Shire Council has prepared Amendment C126 to the East Gippsland Planning Scheme.

 

The land affected by the amendment is in King Street and Slip Road, Paynesville.

 

The amendment implements the findings of the Paynesville Maritime Precinct Master Plan October 2009 and implements some of the findings of the Comparative Study of Planning Instruments, Paynesville Maritime Precinct Slip Road Paynesville, February 2014.

Planning for Bushfire: Mapping and policy update

 

New mapping

The Victorian Government has announced its intention to update the Bushfire Management Overlay (BMO) in all planning schemes across Victoria. This mapping identifies areas considered to be exposed to extreme bushfire risk. This initiative is being undertaken in response to recommendations made in the 2009 Victorian Bushfires Royal Commission.

 

The East Gippsland Planning Scheme already applies the BMO to bushfire risk areas. When implemented the new mapping will extend the application of the BMO in the Scheme. This includes application of the BMO to existing settlements that are potentially exposed to bushfire risk.

 

New requirements for planning permits

Application of the BMO can trigger the need to obtain a planning permit for new development, particularly for dwellings and subdivision, it will also require new buildings to be constructed, consistent with building regulations, to improve resilience to bushfire attack.

 

If you are in an area proposed to be included in the new mapping and you are intending to undertake buildings and works on your land, you need to be aware of these changes.

 

You can check if your land is in the BMO by using the BMO tool using the Victorian Government’s planning maps online tool.

 

Ministerial amendment

This is a Victorian Government initiative and the planning scheme amendment to introduce the new BMO mapping will be prepared and approved by the Minister for Planning, not council.

 

Amendment GC13 to the East Gippsland Planning Scheme introducing the new mapping came into effect with gazettal on October 3, 2017.

 

Under Section 41 of the Planning and Environment Act 1987 the amendment documents must be available for public inspection during office hours.

Submissions

The Victorian Government is not seeking submissions on this amendment. Please direct comments on the BMO’s introduction to the Department of Environment, Land, Water and Planning (DELWP).
